Terms of Service

Welcome to Confidential (“we,” “us,” “the Service”). By creating an account or otherwise using the Service, you agree to these Terms. If you don’t agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use Confidential. You must also be of legal age in your jurisdiction to view and share sexually explicit material. You may not use the Service if local law prohibits it.

2. Accounts

• You are responsible for everything that happens under your account.
• Keep your password secret. Tell us immediately if it’s compromised.
• One human, one account. Impersonation is grounds for termination.
• Creators must provide a date of birth confirming they are 18 or older. Providing a false DOB is grounds for immediate termination.

3. Content you post

You keep ownership of the content you upload. You grant us a worldwide, non-exclusive, royalty-free license to host, display, and deliver your content to the recipients you send it to. You may revoke this license by deleting your content.

You promise that:

• Every person depicted in your content is at least 18.
• You have documented proof of age for every person depicted.
• You own or have permission to share everything you post.
• Your content does not depict minors, non-consensual acts, violence, bestiality, or anything else prohibited below.

4. Prohibited content and conduct

The following will get you banned on sight:

• Any sexual content involving minors (including simulated).
• Non-consensual content, including “revenge” posts, hidden cameras, or leaks.
• Bestiality, incest, or depictions of real violence.
• Trafficking, coercion, or paid content from someone who isn’t the real creator.
• Harassment, threats, doxxing, or hate speech.
• Buying or selling access keys, credentials, or scraped content.

5. Moderation

We remove content and terminate accounts at our discretion. Reports are reviewed by a human moderator. We may preserve records as required by law, including for law-enforcement referrals.

6. Payments

If and when Confidential introduces paid features, additional payment terms will apply and be surfaced before you are charged.

7. Termination

You can delete your account at any time. We can suspend or terminate yours if you violate these Terms. We’ll tell you why unless doing so would compromise a legal investigation.

8. Disclaimers

The Service is provided “as is.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, Confidential will not be liable for indirect, incidental, special, consequential, or exemplary damages. Our aggregate liability will not exceed the greater of $100 or the amount you paid us in the preceding twelve months.

10. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Delaware.

11. Changes

We may update these Terms. We’ll note the “last updated” date at the top and, for material changes, give notice in-app or by email.
